1. Scope of These Terms

These Terms of Use apply to all users of Modern Internal’s services, including but not limited to our website, desktop application, and remotely accessed hardware infrastructure. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Definition of Services

Modern Internal provides users with remote access to high-performance hardware stacks that allow them to install, operate, and stream their own OS for gaming or professional use. Our services include:

• Access to our website and desktop application.
• Remote utilization of our physical hardware infrastructure.
• Secure storage and management of OS installations for eligible users.
• Customer support and troubleshooting assistance.
• Account management and security services.
• Integration with third-party software or services where applicable.

By using our services, you acknowledge and accept that your use is subject to these Terms.

3. Prohibited Uses

You may not use our services to:

• Engage in any unlawful, fraudulent, or offensive activities.
• Distribute, host, or access malicious software, hacking tools, or any content that violates legal protections.
• Infringe upon the rights of other individuals, organizations, or intellectual property holders.
• Conduct cryptocurrency mining, botting, or any unauthorized resource-intensive operations.
• Evade security mechanisms, gain unauthorized access, or manipulate Modern Internal's infrastructure.
• Host, share, or distribute illegal content, including but not limited to pirated software, copyrighted materials, or explicit illegal content.
• Attempt to bypass network restrictions, abuse bandwidth, or engage in activities that degrade service quality for other users.
• Engage in harassment, threats, or abuse towards other users, Modern Internal staff, or third parties.

Violation of these terms may result in the immediate termination of your account and potential legal action.

4. Monitoring and Compliance

Modern Internal reserves the right to employ non-invasive monitoring techniques to ensure compliance with these Terms. If we determine that a user is violating our policies, we reserve the right to:

• Permanently terminate access to our services.
• Issue a full refund if the termination is not due to malicious intent.
• Block associated accounts, IP addresses, and payment methods from future service usage.
• Report violations to law enforcement where applicable.

We do not actively monitor the content stored within a user’s OS installation but reserve the right to investigate suspected violations.

5. Payment Processing & Billing

• Payments for Modern Internal services are processed securely through Stripe.
• By purchasing access, you agree to abide by Stripe’s terms and conditions.
• Modern Internal does not store or process your payment data directly.
• Subscription fees and service charges are subject to change with prior notice.
• Chargebacks, fraudulent transactions, or unauthorized payment disputes may result in account termination and restriction from future services.

Failure to complete payments or unauthorized chargebacks may result in the suspension or termination of service access.

6. Account Usage & Security

• Users may not create more than one account.
• Account sharing, subleasing, or transferring access to third parties is strictly prohibited.
• Users are responsible for maintaining account security, including strong passwords and two-factor authentication (if available).
• If unauthorized access occurs due to negligence, the account holder will be held liable for any resulting activity.
• Users must notify Modern Internal immediately if they suspect unauthorized access or security breaches.

7. Service Availability & Limitations

While Modern Internal strives to maintain 99.9% uptime, we cannot guarantee uninterrupted access due to:

• Scheduled maintenance and upgrades.
• Unexpected downtime due to hardware failures, network disruptions, or cybersecurity threats.
• External dependencies, including third-party providers, that may impact service availability.
• Force Majeure Events, including but not limited to natural disasters, power outages, and regulatory actions.

We will make reasonable efforts to notify users of planned disruptions, but Modern Internal is not liable for any losses resulting from service downtime.

8. Data Retention & Deletion

• Upon subscription expiration, Modern Internal will retain an ISO backup of your OS installation for one year.
• After one year, the backup is permanently deleted.
• Users may request immediate deletion at any time by contacting support.
• Modern Internal is not responsible for any data loss resulting from expired storage periods.

9. Modifications to Services & Terms

Modern Internal reserves the right to modify, suspend, or discontinue any aspect of the service at our discretion. We may also update these Terms of Use periodically. Continued use of our services after updates constitutes acceptance of the revised terms.

10. Liability & Disclaimers

• Modern Internal is not responsible for any data loss, system failures, or damages incurred through the use of our services.
• We do not guarantee that our services will be free from errors, vulnerabilities, or external attacks.
• Users assume full responsibility for their data, security, and compliance with applicable laws.
• Modern Internal does not provide warranties for uninterrupted, error-free, or fully secure access to its services.

Use of our services is at your own risk.

11. Governing Law & Dispute Resolution

Users waive the right to participate in class action lawsuits against Modern Internal and agree that any legal claims shall be pursued individually.
